Middleton -v- Surrey County Council
On 23rd December 2010 the Claimant, Mr David Middleton, was driving along the A242 in Redhill, Surrey, when a maturing ash tree fell hitting his car causing damage and injuring him. The tree had extensive basal decay that was hidden by ivy. The tree was inspected 17 months before the incident by means of a drive-by inspection, but the decay was not discovered. In the judgment of 27th March 2015, the case was found in favour of the Claimant.
